These terms apply to your use of kensingtonpersonnel.com. They are short, and we have tried to write them plainly. By using the site you accept them. If you do not, please do not use the site. You are welcome to write to us instead at office@kensingtonpersonnel.com.

Who we are.

This website is operated by Kensington Personnel. Kensington Personnel is the trading name of a company registered in England and Wales. The registered company name, company number and registered office address will be published here shortly. We work from offices in London, Dubai and Marbella.

You can reach us at office@kensingtonpersonnel.com.

What these terms cover.

These terms cover the website only. They are not our terms of business.

  • Our work for households is carried out under separate written terms of business, agreed with each client before a search or a training programme begins. The placement assurance described on this site is given on those terms and is subject to them.
  • Our work with candidates is carried out on the terms we give to each candidate when we first offer our services.

If anything on this site differs from the written terms we have agreed with you, the written terms apply.

What this site is, and what it is not.

The site describes what we do, shows a selection of the positions we have been asked to fill, and gives you three ways to begin a conversation: a request to hire, a request to train, and an application as a candidate.

Kensington Personnel is an employment agency. We introduce candidates to households. The household is the employer. Where we act in any other capacity for a particular assignment, the written terms for that assignment will say so.

Nothing on this site is an offer of employment. A position shown here is an invitation to apply. Sending us an application, and receiving a reply, does not create a contract of employment or a promise of an introduction. An offer can come only from the household concerned, after interview, and the contract of employment is between the candidate and that household.

Nothing on this site commits a household to engage us. Sending us an enquiry places you under no obligation. Our engagement begins only when terms of business have been agreed.

We do not charge candidates for finding them work. UK law does not allow an employment agency to do so, and we would not wish to.

Positions we advertise. Every position on this site is advertised by Kensington Personnel and states whether it is permanent or temporary. We advertise a position only with the authority of the household concerned. To protect the household, a position is described by city and reference rather than by name or address. Positions are filled and withdrawn without notice, and a position that appears here may no longer be open when you read it.

Using the site.

You may use the site to read about our services, to view positions and to contact us. In doing so you agree:

  • to give information that is true, and that is yours to give. If you give us details of another person, such as a referee, please make sure they know;
  • not to apply on behalf of someone else without their knowledge;
  • not to send unsolicited marketing, or candidate details from another agency, through our forms;
  • not to copy the site or its content by automated means, or to collect the details of positions for publication elsewhere;
  • not to attempt to gain access to any part of the site, its forms or its systems that is not open to you, or to interfere with how it works; and
  • not to use the site in any way that is unlawful or that could harm us, our clients or our candidates.

We may withdraw access from anyone who does not keep to these terms.

Accuracy.

We take care that what appears here is right on the day it is published, and we correct errors when we find them. The site is nonetheless a general description, and we ask you to read it as one.

  • Positions. Details of a position, including location, package and start date, are a summary of the brief we have been given. They may change as the search develops, and they are confirmed only in the household’s written offer.
  • Timescales. Where we describe how long something usually takes, such as the time to a shortlist or to a reply, we are describing what we aim for. The timescale for your search will be agreed with you.
  • The staff finder. The staff finder offers a suggestion based on your answers. It is a starting point for a conversation, not advice.
  • Insights. Our articles set out our views and general information. They are not legal, tax, immigration or employment advice, and the rules they mention change. Please take advice on your own circumstances before acting.

Intellectual property.

The text, photography, design and layout of this site, and the name Kensington Personnel, belong to us or are used with the permission of their owners. They are protected by copyright and other rights.

You may view the site, print pages and share links for your own private use, or to consider our services within your household or office. You may quote a short passage if you name Kensington Personnel as the source.

You may not otherwise copy, republish, adapt or sell any part of the site, remove any notice of ownership from it, or use our name in a way that suggests a connection with us that does not exist, without our written permission.

Links.

Where this site links to another website, the link is there for your convenience. We do not control other websites and are not responsible for what they say or for how they handle your information.

You may link to our home page or to any page of this site, provided you do so fairly and do not suggest that we endorse you or your services. Please do not present any part of the site inside a frame on another site.

Privacy and confidentiality.

How we handle personal information, including what you send through the forms, is set out in our Privacy policy. How we protect the confidence of households and candidates is set out in our Discretion policy.

Availability and security.

The site is provided free of charge. We do not promise that it will always be available or free from interruption, and we may change, suspend or withdraw any part of it without notice.

We take reasonable steps to keep the site secure, but we cannot promise that it will be free from viruses or other harmful code. You are responsible for protecting your own device with suitable software.

Email and web forms are not perfectly secure. Please do not send identity documents or other sensitive material through the forms. We will tell you how to send them once we have replied.

Our responsibility to you.

Nothing in these terms excludes or limits our liability where the law does not allow it to be excluded or limited. That includes liability for death or personal injury caused by our negligence, and for fraud or fraudulent misrepresentation.

If you use the site as a consumer, which is to say as an individual acting for purposes outside your trade, business or profession, you have rights in law that these terms do not reduce. If we fail to keep to these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our failure. We are not responsible for loss that is not foreseeable.

If you use the site in the course of a business, including as a family office or an agency, we exclude all implied conditions, warranties and representations so far as the law allows, and we are not liable for loss of profit, loss of business, loss of opportunity or any indirect or consequential loss arising from your use of the site, or your inability to use it.

In either case, the site is a source of general information. Our responsibility for the services we provide to you, and its limits, are set out in the written terms we agree with you and not here.

Changes to these terms.

We may revise these terms from time to time. The date at the top shows when they were last changed. The terms that apply are those published on the day you use the site.

Governing law.

These terms, and any dispute or claim arising from them or from your use of the site, are governed by the law of England and Wales.

The courts of England and Wales have jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in the courts of the country in which you live. If you are a consumer living outside the United Kingdom, nothing in these terms takes away the protection of any mandatory law of the country in which you live.

Contact.

Questions about these terms may be sent to office@kensingtonpersonnel.com.
